Anethings Terms of Service

Preamble

Welcome to Anethings. By accessing or utilizing the Anethings mobile application, website, or associated digital services (collectively, the "Platform"), you explicitly agree to be bound by these Terms of Service ("Terms"). The Platform supports both transactional asset rentals and permanent asset transfers (sales). If you do not agree to these Terms, you are strictly prohibited from utilizing the Platform.

1. About Anethings

Anethings operates strictly as an intermediary technology marketplace platform that connects:

  • Users seeking to lease items ("Renters") with users listing items for lease ("Hosts").

  • Users seeking to purchase items ("Buyers") with users listing items for permanent sale ("Sellers").

Hosts and Sellers may operate under a single unified user account. Listings may be designated exclusively for lease, exclusively for purchase, or concurrently for both transaction models based on app configuration and availability.

Anethings:

  • Does not maintain ownership, custody, storage, inspection, or logistics handling of any listed items.

  • Does not operate as a contractual party to any independent rental or sale transaction executed between users.

  • Provides solely the technical infrastructure to discover listings, request rental reservations, process platform fees, unlock merchant contact details (where offered), and facilitate direct user communication.

All rental and sales arrangements constitute separate, direct contracts between the participating users. Anethings is not a buyer, seller, lessor, landlord, or merchant of record for any underlying asset.

2. Eligibility

By accessing or creating an account on the Platform, you represent and warrant that:

  • You are at least 18 years of age and possess full legal capacity to enter into binding contracts.

  • All profile, identification, and registration data provided by you is accurate, current, and complete.

  • You will not utilize the transactional, rental, or sales features of the Platform to trade or distribute prohibited items.

3. Listing and Transaction Specifications

Users may publish listings for lease, sale, or a hybrid of both (subject to configuration parameters permitted by the Platform), including:

  • Consumer electronics, imaging gear, and computational hardware.

  • Musical instruments and audio-visual gear.

  • Commercial tools, mechanical equipment, and consumer accessories.

  • Temporary lodging, homestays, and analogous accommodations.

  • Other legally tradeable physical property owned by the listing user or to which they hold explicit transfer rights.

When publishing an asset for sale, you must set an accurate pricing structure, clearly define verified item conditions, and immediately mark the item as sold upon transaction completion or off-platform unavailability.

Specific Asset Rules (Vehicles & Transportation):

  • For Sale: Users are explicitly permitted to list motor vehicles, automobiles, motorcycles, and scooters strictly for permanent sale and transfer of ownership.

  • For Rent (Strict Prohibition): Users are strictly prohibited from listing motor vehicles, automobiles, motorcycles, or scooters for transient rentals or lease. Any attempt to use the Platform to run an unauthorized vehicle rental service will result in an immediate account suspension or permanent termination.

Prohibited Items (Categorically Excluded):

  • Items requiring specialized statutory government licenses or regulatory registration without lawful compliance.

  • Arms, weapons, and military ammunition.

  • Stolen property or property you do not maintain clear title or the explicit legal right to rent or sell.

  • Counterfeit or fraudulently represented goods.

  • Hazardous chemical compounds, narcotics, or other items illegal to trade under applicable law.

Anethings reserves the absolute right to remove any listing or suspend any account found in violation of these parameters without prior notice.

4. Intermediary Platform Disclaimer (Vehicle Sales)

Because the Platform facilitates peer-to-peer vehicle sales connections, you explicitly acknowledge and agree that:

  • No Title Verification: Anethings does not inspect vehicle Registration Certificates (RC), verify chassis or engine numbers, check for active police cases or traffic challans, or validate hypothecation (loan/bank NOC) status.

  • RTO Compliance: The complete responsibility for checking ownership history, vehicle fitness, insurance, pollution certificates, and processing the statutory legal ownership transfer (including Form 29 and Form 30) at the Regional Transport Office (RTO) lies entirely with the Buyer and Seller.

  • Test Drive & Meetup Risks: Anethings disclaims all liability for any accidents, thefts, property damage, personal injury, or other civil wrongs that occur during user-arranged physical meetups, inspections, or vehicle test drives.

  • Payment & Delivery: Unless checkout clearly states otherwise, vehicle sale amounts are negotiated, paid, and settled between users directly. Anethings is not a party to the transfer of title or physical possession.

5. Marketplace Disclaimer

You acknowledge and agree that:

  • Anethings functions solely as an intermediary technology infrastructure provider.

  • Anethings provides no warranties regarding the quality, safety, legality, authenticity, or operational condition of any listed items (including motor vehicles).

  • Anethings does not independently audit, vet, or guarantee the identity or conduct of individual users, listings, documentation, or off-platform transaction fulfillment.

  • Anethings disclaims all liability regarding physical meetups, test drives, handovers, or logistics arrangements settled by users.

Anethings assumes zero liability for:

  • Any loss, theft, destruction, or physical damage sustained by any asset.

  • Personal injuries, accidents, property damage, or civil wrongs arising during rentals, sales, or meetups.

  • Fraud, financial misrepresentation, scams, or failed financial settlements conducted off-platform.

  • Transaction delays, user disputes, booking cancellations, or operational failures occurring between parties.

  • Buyer–seller or Renter–Host trade agreements finalized outside the structured Platform database.

All platform interactions are conducted at the user’s sole risk. Users are explicitly instructed to thoroughly inspect physical assets, verify registration documents, and confirm legal compliance before executing any external financial settlements or taking possession.

6. User Responsibilities

Hosts and Sellers:

  • Must hold clear title or absolute legal authorization to lease or sell the listed property.

  • Must ensure listings are accurate, including genuine item photography, precise condition assessments, price, and verified availability statuses.

  • Assume total liability for physical logistics, handover protocols, delivery disputes, and any statutory tax obligations or local permits applicable to them.

  • Shall not engage in deceptive pricing or provide misleading documentation to prospective Buyers or Renters.

Renters:

  • Shall operate, utilize, and maintain leased items in a lawful, responsible manner.

  • Are required to return leased items to the Host within the designated timeline and in the exact condition received.

  • Assume full financial liability for asset damage, depreciation beyond normal wear and tear, or loss as agreed with the Host.

Buyers:

  • Agree to utilize procurement features lawfully and communicate honestly with Sellers.

  • Bear sole responsibility for verifying the asset quality, seller legitimacy, and settlement terms prior to finalizing a purchase.

  • Explicitly acknowledge that within the standard purchase workflow, the item procurement price is transferred directly to the Seller, and Anethings does not hold or escrow these funds unless an explicit in-app escrow checkout interface is deployed at the time of payment.

  • For vehicle purchases: must independently verify the RC, active insurance policies, fitness certificates, outstanding challans or loans, and complete all RTO transfer formalities (Form 29/30).

Vehicle Sellers:

  • May list motor vehicles, automobiles, motorcycles, and scooters strictly for sale—never for rental or lease purposes.

  • Must disclose all material facts regarding vehicle ownership history, past accident involvements, active financing, and documentation status.

  • Are solely responsible for executing the lawful transfer of title, ownership forms, and physical possession.

All platform participants are bound to operate in strict compliance with applicable federal, state, and local laws.

7. Payments & Platform Fees

7.1 Rentals: Rental valuations are set exclusively by Hosts. Anethings may charge a platform or booking fee and facilitate rental-related transactions as displayed at the checkout interface. Rental cancellation protocols are governed under Section 8.

7.2 Buy / Sell — Connection Fee: To bridge communication with a Seller regarding a listed asset, a Buyer may be assessed a fixed, non-refundable Connection Establishment Fee (currently set at ₹29 per separate transaction unlock, subject to adjustment within the application configuration). This fee constitutes consideration for digital matching infrastructure, does not form part of the underlying asset purchase price, and is non-refundable upon access grant except under verified systemic technical failure.

7.3 Independent Asset Pricing: Barring instances where the checkout flow explicitly states that Anethings is processing the transaction under a structured escrow mechanism, all item purchase values are settled independently between the Buyer and Seller. Anethings disclaims all responsibility for payment routing, delivery fulfillment, or purchase price refunds for these transactions.

7.4 Buy / Sell — Escrow (If Offered): Where the application explicitly facilitates integrated checkout processing for a sale, the item purchase price plus a platform commission fee (currently set at 2% of the aggregate gross sale value, subject to floor and ceiling caps defined at checkout) will be processed through integrated third-party payment aggregators. Disbursement, holding, and retention rules will be explicitly displayed prior to authorization.

7.5 Promotional Instruments: Discretionary discounts or promotional credits apply strictly to specified fee classes and cannot be combined or applied to separate platform fee structures unless explicitly configured.

8. Cancellation and Refund Protocols

8.1 Rental Framework Notice: Rental agreements are executed exclusively between Renter and Host. Anethings maintains no ownership over assets and does not govern host discretionary choices.

8.2 Rental Cancellation by Renter: Subject entirely to the selected cancellation window established by the Host. Purchase refunds, if any, are governed by individual Host policies, and Anethings provides no refund guarantees.

8.3 Rental Cancellation by Host: If a Host revokes a reservation due to valid operational necessities, resolution and potential reallocations are handled under platform-guided rules and Host cancellation policies.

8.4 Platform Fee Architecture: Booking fees and platform service percentages collected by Anethings during rental execution remain non-refundable unless systemic processing exceptions occur.

8.5 Connection Fee Exclusions: Upon successful backend provisioning of a communication link or chat channel between a Buyer and Seller, the Connection Establishment Fee is immediately earned by the platform and is non-refundable regardless of transaction finalization, user dissatisfaction, change of mind, or quality variances.

8.6 Sales Price Adjustments: Restitution, refunds, or reversals of asset purchase prices remain a private civil matter settled exclusively between the Buyer and the Seller, unless a managed platform escrow checkout sequence was explicitly utilized and stated otherwise.

8.7 Systemic Reversals: In events where capital is successfully debited from a user account but backend database confirmation fails due to verifiable technical, server-side infrastructure faults, a standard reversal protocol will be initiated following internal review.

8.8 Non-Refundable Incidents: Reversals are categorically denied in instances involving consumer change of mind, off-platform transaction friction, regulatory or policy breaches, user damage, fraudulent claims, or buyer non-appearance.

9. Code of Conduct and Community Compliance

Users are bound by strict operational codes of conduct requiring them to:

  • Present structurally accurate data across profiles, digital listings, integrated chats, and review fields.

  • Maintain civil, non-abusive communication free from harassment, threats, or hate speech.

  • Publish listings exclusively for permissible and legally tradeable physical property in compliance with Section 3.

  • Never list motor vehicles for rent or lease.

  • Settle all required platform usage fees (such as booking fees or Connection Establishment Fees) through the designated app channels without executing circumvention mechanisms.

  • Refrain from engaging in phishing, spamming, credential manipulation, or artificial identity creation.

  • Maintain property integrity and observe timely return schedules during rental execution.

  • For sales (including vehicles): provide completely truthful information and complete all RTO and payment steps at your own financial risk.

  • Leave honest, fair, and objective reviews where offered.

Strictly Prohibited Conduct: Vehicle rentals, handling stolen or counterfeit items, listing weapons or restricted chemical compounds, manufacturing artificial account networks, or leveraging unlocked user data for harassment. Anethings retains unbridled discretion to scrub content or permanently sever account access for breaches without prior warning.

10. Disputes Between Users

  • Dispute lines arising from rental contracts remain strictly between the respective Renter and Host.

  • Dispute lines arising from sales contracts remain strictly between the respective Buyer and Seller.

  • Anethings may deploy limited informational assistance or software-driven moderation tools but assumes no legal duty or binding obligation to settle user claims, recover assets, or execute capital reversals for off-platform transactions.

  • Anethings assumes zero liability for final user dispute adjudications.

11. Limitation of Liability

To the maximum extent permitted under applicable law, Anethings, along with its corporate founders, directors, employees, and technical maintainers, shall not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This exclusion encompasses, without limitation, loss of capital, operational revenue, proprietary data, corporate goodwill, or physical asset loss arising from rentals, purchases (including vehicle sales), communication unlocks, data transmissions, off-platform transactions, RTO transfers, test drives, or user meetups. Use of the Platform remains at your individual peril.

12. Indemnification

You agree to defend, indemnify, and hold harmless Anethings, its parental entities, corporate officers, founding team, and strategic partners from and against any third-party claims, liabilities, financial losses, regulatory damages, or legal costs arising from your active utilization of the platform, your specific listings, your lease or sale transactions (including vehicle sales), platform messaging, physical meetups, test drives, off-platform transactions, RTO non-compliance, or your direct violation of these Terms or statutory laws.

13. Administrative Suspension and Account Severance

Anethings maintains an absolute right to restrict, suspend, or permanently terminate any user profile or access pathway at its sole discretion for policy infractions, system manipulation, listing of prohibited assets, unauthorized vehicle rental configurations, provision of false vehicle documentation, or actions deemed detrimental to platform safety or user environment security.

14. Modifications to the Binding Terms

Anethings retains full discretionary authorization to update or revise these Terms at any interval. Continued systemic access or transactional deployment of the platform following updates constitutes full, legally binding ratification of the modified Terms.

15. Statutory Governing Law and Jurisdictional Venue

These Terms, their construction, and any contractual obligations arising out of them are governed exclusively by the laws of the Republic of India. Any legal actions or proceedings arising directly out of these platform rules shall be instituted exclusively within courts of competent jurisdiction.
